1. About These Terms

The Lux Baro is a brand independently operated from China. These Terms of Service explain the rules that apply when you visit, browse, or purchase from our website and online store (the “Services”). The Services are powered by Shopify.

By using the Services, you agree to these Terms, our Privacy Policy, Shipping Policy, and Return and Refund Policy. If you do not agree, please do not use the Services. Nothing in these Terms limits any consumer right that cannot legally be limited or excluded.

2. Eligibility and Accounts

You must be at least the age of majority where you live, or have permission from a parent or legal guardian, to make a purchase.

You agree to provide accurate, current, and complete information when placing an order or creating an account. You are responsible for keeping your login details secure and for activity carried out through your account. Please contact us promptly if you believe your account has been used without authorization.

3. Products and Product Information

We make reasonable efforts to describe and display our products accurately. Screen settings, lighting, photography, and the natural characteristics of materials can cause minor differences in color, pattern, texture, or shape. Natural stones, pearls, wood, and similar materials may have individual variations. These variations are not necessarily defects, but stated measurements and product descriptions still apply, and your mandatory consumer rights remain unaffected.

Product availability, descriptions, and prices may be updated. We may discontinue a product or limit quantities where reasonably necessary. We do not make medical, therapeutic, protective, or other health-related claims about our jewelry or materials.

4. Orders and Acceptance

Submitting an order is an offer to purchase. An order is accepted only after payment is authorized and we send an order confirmation or begin fulfillment. We may reject or cancel an order for a legitimate reason, including unavailable stock, an obvious pricing or description error, suspected fraud, payment failure, shipping restrictions, or a purchase that appears intended for unauthorized resale. If we cancel an order after payment, we will refund the affected amount to the original payment method.

Please review your order carefully before submitting it. If you wish to cancel an order before shipment, please contact us at theluxbaro@gmail.com as soon as possible.

If your order has not yet entered packing or logistics processing, we can cancel it and issue a refund to your original payment method. If your order has already entered packing or logistics processing but has not yet shipped, we will review its status and confirm whether cancellation is still possible.

Once an order has been shipped, our Return and Refund Policy applies. These cancellation procedures do not limit any mandatory cancellation rights available under applicable law.

Products purchased from our store are intended for personal or household use unless we agree otherwise in writing. You may not purchase products for unauthorized commercial resale.

5. Prices, Payment, Taxes, and Import Charges

Prices are shown in the currency displayed at checkout. The amount you pay is the amount displayed when you submit your order. If that amount is incorrect because of an obvious system, entry, or calculation error, we will contact you before shipment. We will not charge a higher price without your agreement. You may choose to continue at the correct price or cancel the order and receive a full refund to the original payment method. Shipping charges and taxes collected by us will be shown before you complete checkout.

International orders may be subject to customs duties, import taxes, brokerage charges, or other fees imposed by the destination country. Unless checkout or the Shipping Policy expressly states that we collect these charges, they are not included in the product price or shipping fee and may be payable by the recipient. We do not control charges imposed by customs or local authorities.

Payments are processed by Shopify, PayPal, or another payment service provider. You confirm that you are authorized to use the selected payment method and that the payment and billing information you provide is accurate. Refunds are issued to the original payment method.

6. Shipping and Delivery

Available destinations, shipping charges, estimated delivery times, and any free-shipping threshold are described at checkout and in our Shipping Policy. Delivery estimates are not guaranteed. Delays may occur because of carriers, customs, weather, public holidays, incorrect delivery information, or other circumstances outside our reasonable control.

We remain responsible for the order until delivery to you to the extent required by applicable consumer law. If tracking shows a problem, or your package is lost or arrives damaged, contact us promptly so that we can review the matter with the carrier. 7. Returns, Exchanges, Refunds, and Product Problems

Returns, exchanges, refunds, damaged items, incorrect items, and final-sale items are governed by our Return and Refund Policy. Change-of-mind returns and product problems follow different procedures. You must contact us before sending an item back so that we can provide instructions and, where required, authorize the return.

Nothing in these Terms or our policies limits any mandatory right or remedy available for products that are defective, damaged in transit, incorrectly supplied, or not as described.

8. Intellectual Property

The website and its content, including text, photographs, graphics, videos, audio, layout, product presentation, branding, and design, are owned by or licensed to the operator of The Lux Baro, Shopify, or the relevant rights holder and are protected by applicable intellectual-property laws.

You may use the website only for personal, non-commercial shopping and information purposes. Without prior written permission, you may not copy, reproduce, modify, distribute, publish, sell, commercially exploit, or create derivative works from website content, except where applicable law expressly permits it. No ownership or intellectual-property right is transferred to you by your use of the Services.

9. Acceptable Use

You may not use the Services to:

• Break the law or infringe another person’s rights;
• Submit false, fraudulent, abusive, defamatory, discriminatory, or harmful material;
• Introduce malware or interfere with the website, checkout, accounts, security, or availability;

The Services may include tools, payment services, links, or content provided by third parties. Their own terms and privacy policies apply when you use them. We are not responsible for a third party’s independent website, service, content, or conduct, but this does not exclude responsibility that applicable law places on us.

11. Relationship with Shopify

The Lux Baro is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with The Lux Baro. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and The Lux Baro, including any injury, damage, or loss resulting from purchased products and services. To the fullest extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to purchases and transactions with The Lux Baro.

12. Privacy

Our collection and use of personal information are described in our Privacy Policy. Because the Services are hosted by Shopify, Shopify also processes certain information to provide, secure, and improve its services, as further described in the Privacy Policy.

13. Errors and Availability

Information on the Services may occasionally contain a typographical error, inaccuracy, or omission relating to a description, price, promotion, shipping charge, delivery estimate, or availability. We may correct the information and, where reasonably necessary, cancel an affected order. If an accepted and paid order is cancelled, we will refund the affected amount to the original payment method.

14. Service Availability and Legal Warranties

We aim to keep the Services available and accurate, but we cannot promise that the website will always be uninterrupted, secure, or free from technical errors. We may temporarily restrict access for maintenance, security, updates, or events outside our reasonable control.

To the fullest extent permitted by law, the Services are provided on an “as available” basis. However, nothing in these Terms excludes or limits any warranty, guarantee, remedy, or consumer right that cannot legally be excluded or limited, including rights relating to products that are defective, unsafe, incorrectly supplied, or not as described.

15. Limitation of Liability

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, punitive, or consequential loss that was not reasonably foreseeable when the relevant transaction occurred, including loss caused solely by your misuse of the Services or by circumstances outside our reasonable control.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, willful misconduct, or any other liability that cannot legally be excluded or limited. Nothing in this section limits your mandatory consumer rights or our obligations concerning the products we sell.

16. Your Responsibility for Misuse

To the extent permitted by law, you are responsible for reasonably foreseeable loss caused by your unlawful use of the Services, intentional violation of these Terms, or infringement of another person’s rights. This section does not make you responsible for loss caused by us, Shopify, or another service provider.

17. Suspension and Termination

You may stop using the Services at any time. We may suspend or terminate access where reasonably necessary because of fraud, unlawful conduct, a security risk, non-payment, or a material violation of these Terms. Termination does not cancel payment obligations already incurred or rights and obligations that by their nature continue after termination.

18. Governing Law and Consumer Rights

These Terms are governed by the laws of the People’s Republic of China, without regard to conflict-of-law rules. Disputes may be submitted to a court with legal jurisdiction over the operator of The Lux Baro in China.

If mandatory consumer law in the country or region where you live gives you additional protections or permits you to bring a claim in your local courts, this section does not take those rights away.

19. Changes to These Terms

We may update these Terms to reflect changes to the Services, our business, or legal requirements. The current version will be published on this page with a revised “Last updated” date. Material changes will apply from the date stated in the notice and will not retroactively reduce rights relating to an order already accepted, unless applicable law permits or requires otherwise.

20. General Terms

If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply. A delay or failure to enforce a provision does not waive the right to enforce it later.

These Terms, together with the policies referred to in them, form the agreement governing your use of the Services. If a specific promotion has separate terms and those terms conflict with these Terms, the promotion terms apply to that promotion.
